ENCINO · CONTESTED TRUST
A contested trust, a shifting market, and zero objections.
After litigation removed the original trustee, a court-appointed professional fiduciary contacted us to sell an Encino property with an out-of-town beneficiary. The assignment required careful property oversight, clear communication, and a documented basis for the sale recommendation.
One example from the many probate, trust and conservatorship sales we have handled. Client details are kept private.

The problem
The market was moving quickly. Comparable sales used before launch needed to be reassessed as competing properties and buyer expectations changed.
The home’s appeal also extended beyond its existing condition. As the neighborhood evolved, its lot and development potential became central to the marketing.
Prospective buyers needed to understand the anticipated 45-day notice of proposed action period before submitting an offer, so their expectations and proposed closing timelines reflected the process.
What we did
We secured the vacant property and replaced the locks. Photography, extensive video, drone footage, and a streamed virtual open house presented the home to a broad audience, with particular attention to the lot’s dimensions, features, and potential.
When early offers fell short, we continued advertising and buyer outreach while updating the fiduciary on market conditions and feedback.
We tracked inquiries, calls, online activity, private showings, and feedback from buyers and neighbors. Together with offer comparisons and updated pricing advice, those records helped the fiduciary evaluate the options and explain the proposed sale.
Before buyers submitted offers, we explained the anticipated notice period and its effect on closing. We also coordinated responses to questions about recorded easements with the title company, directing development questions to the appropriate authorities.
The result
The marketing generated 10 offers and an all-cash, non-contingent sale. The final price came in $200,000 or more above the early offers. We assembled a supporting file to help the fiduciary seek consent, and no objections were raised to the notice of proposed action.
The sale closed without seller credits or repairs.
