SOUTH LA · PROBATE · NO INTERIOR ACCESS

Foreclosure paused. Two homes sold without anyone stepping inside.

An out-of-town estate administrator contacted us about two neighboring homes in South Los Angeles. Both were occupied, access was being denied, and foreclosure threatened the estate’s equity.

One example from the many probate, trust and conservatorship sales we have handled. Client details are kept private.

The problem

The estate needed to move quickly. A special administrator had been appointed amid the foreclosure pressure. The homes were occupied, and the occupants were not cooperating with access.

The administrator lived out of town. Preparing and showing the interiors was not possible, so the sale required a strategy that addressed both the approaching foreclosure and the uncertainty buyers would face.

What we did

We contacted the foreclosing bank directly. After we provided the listing agreement and the payoff plan, the lender agreed to postpone the foreclosure sale, allowing the sale to proceed.

We made repeated attempts to obtain access and documented those efforts. When access remained unavailable, we arranged exterior and aerial photography and marketed the homes to cash buyers willing to purchase with occupants in place and without interior inspections.

We provided price opinions and documented how the access restrictions affected buyer interest and the sale process. That information helped the administrator and counsel evaluate the impact on the estate.

As offers arrived, we reviewed buyer qualifications, compared terms, and coordinated the accepted sales with the administrator, attorney, escrow, and title.

We also prepared potential overbidders with the disclosures, instructions, and deposit requirements for court, and attended the confirmation hearing.

The result

The two homes drew 10 and 6 offers despite the lack of interior access.

There were no overbids at the hearing, and the court confirmed the sales to the original accepted buyer. Both purchases closed within ten days of receiving the court order.

The sales allowed the mortgage obligations to be paid through escrow, avoiding foreclosure.
